GENERAL REGULATIONS - SECTION 1

Entrance, use of the facility and general conditions of sale of services

1.1.  GENERAL CONDITIONS

(Mandatory regulations) The purchase of an admission ticket, reservation of a stay, and/or entry into the facility for visitors without a ticket commits them to abide by all the rules contained in these regulations.

(Prohibition of access) Management reserves the right, at its sole discretion, to deny access to the facility to unwelcome persons or those who have previously violated the rules of these regulations.

(Information and briefing) All those who access and/or use the services of the facility and engage in sports and/or spa activities are required to read and understand these regulations and to carefully follow all the directions that will be provided, in order to ensure their own safety and physical integrity and that of other persons participating in the activities. To this end, the Management provides through this regulation, briefing and information, guidance on the obligations and proper behaviors to be followed. Organized activities, apnea or scuba: in order to participate in the activities, it is mandatory to attend the initial briefing, during which the rules of behavior and safety will be explained. The participant agrees to attentively follow the information briefing that will be given by the facility staff on duty and/or video and/or paper before the activities. In the full knowledge that the information he/she will receive is inherent in how to behave during the activities.

(Contrast of teaching standards) By signing these regulations, participants in the activities agree that should there be a conflict between the standards received from the institution/federation/teaching institution to which they belong and the norms and/or standards set forth in these regulations, the latter, without different and express authorization from the Management, shall be deemed to take precedence over the teaching standards.

(Minors of 18 years of age or non-autonomous persons) Minors of 18 years of age or non-autonomous persons are admitted to the activity in general, on the pool deck or in the saunas only if accompanied by a parent/guardian or a person who takes specific responsibility for them. In order to allow access and stay in the facility, the service staff reserves the right to verify the age of children unaccompanied by a parent, by request to show a personal identification document or alternatively in possession of a permit signed by a parent/guardian with a copy of the identity card of the signer of the permit attached. Organized activities, apnea or scuba: it is also mandatory, when diving, to be accompanied (in pairs) by a parent, guardian or a person delegated by them who signs an “assumption of responsibility” form and holds a patent equivalent to or higher than minors.

(Declaration of assumption of responsibility for participant under 18 years of age or non-autonomous person) In his or her capacity as accompanying acquaintance or parent exercising parental authority over the minor child, or the person acting as his or her legal guardian (minors under 14 years of age may access the activities only if accompanied by at least one of the parents or by proxy of the parents). Declares to accompany and assume responsibility for the minor/non-autonomous person and to maintain control over the same during all activities within the hotel and Y-40®; to supervise compliance with the regulations; also declares that he/she is aware that without his/her supervision, control and assumption of responsibility the activities in the facility would not be usable to the minor/non-autonomous person. By signing this deed, he/she declares that he/she is aware that the reliance placed on him/her causes the minor/non-autonomous person to assume a position of guaranty with respect to the minor/non-autonomous person.

(Forms) It is mandatory to have all members of one’s group sign these regulations prepared by Hotel Teme Millepini and Y-40® The Deep Joy. The person in charge of the group, the booking party, undertakes and therefore is obliged to inform their group that the regulations must be read and understood in every part before signing and that the Management office is at their disposal for any doubts or clarifications.

1.2 BOOKING AND RATES OF ACCOMODATIONS, ACTIVITIES AND FACILITY ACCESS

(Web Reservation) Web reservation is required to access the activities. The Management does not guarantee access to the services to those who have not booked entry or stay through the appropriate procedure.

(Non-nominal reservation) The user can request free of charge the replacement of the person indicated in the web reservation with another person. At the time of purchase, the reservation is not nominal and can be transferred to a third party who can use it under the same conditions. Once checked in, the assigned room and/or activity is understood to be nominal and cannot be transferred to a third party.

(Theft or Loss of Admission Ticket) Hotel and Y-40® are not responsible in case of loss or theft of admission documents, nor in case of unauthorized use of the same.

(Non-refundable prepaid rate) The non-refundable prepaid rate requires the balance of the full amount at the time of purchase. Once the purchase is made, the service is no longer refundable. A credit card is required to make the reservation, or bank transfer, within 24 hours upon confirmation of the reservation request by phone or email, as directed. The non-refundable prepaid rate is usable for booking stays and activities, subject to limited conditions and availability. Only web-based reservation, ensures the right to access the facility on the day and time indicated in the reservation. Reservations can be made at the facility subject to schedule availability and organizational needs. The reservation is not nominal, is non-refundable, and validity is limited to the dates and shifts booked. Once checked in, the service is nominal and use cannot be transferred to a third party. The non-refundable prepaid rate is valid for the stay and activity fee. No additional discounts or conventions apply to the nonrefundable prepaid rate. If you have a special convention of discounted rates please indicate it in your reservation. The convention, if any, will be applicable on the portion rate related to what is specified in the agreement.

(Flexible prepaid rate) The flexible prepaid rate requires payment of deposit, as indicated in the document, and balance at the facility, without requiring prepayment of the full amount. A credit card is required to make the reservation, or bank transfer upon confirmation of the reservation request by phone or email, as indicated. The flexible rate allows for changes up to the specified date without penalty. Subsequent changes will result in the loss of the entire deposit paid. If a change is received within the time limit, it is possible to request a voucher, in the same amount as the deposit paid, valid 365 days from the date of its issuance or by the date indicated on the document. The flexible prepaid rate can only be used for booking stays but not activities, which are subject to limited conditions and availability. Only web booking, ensures the right to access the facility on the day and time indicated in the reservation. Reservations can be made at the venue subject to availability of times and organizational needs. The reservation is not nominal and validity is limited to the dates booked. Once checked in, the service is nominal and use cannot be transferred to a third party. No additional discounts or conventions apply to the flexible prepaid rate. If you have a special convention of discounted rates please indicate it in your reservation. Any convention will be applicable on the portion rate related to what is specified in the agreement.

(Non-refundable voucher rate) The non-refundable voucher rate requires the balance of the full amount at the time of purchase and allows you to postpone the booking of services to a later time. Once the purchase is made, the service is no longer refundable. A credit card is required to make the reservation, or bank transfer, within 24 hours upon confirmation of the reservation request by phone or email, as directed. The voucher can be used for reservation of stays and activities, at a later time after purchase, subject to conditions and limited availability. Only web booking (with use of the voucher), ensures the right to access the hotel and facility on the day and time indicated in the reservation. Reservations can be made at the venue subject to schedule availability and organizational needs. Vouchers are not nominal; codes used for booking are non-refundable. Validity is 365 days from issuance or by the date indicated on the document. Once the voucher code is used, the validity will be limited to the dates and shifts booked and is not changeable. The service at the time of purchase is not nominal and can be transferred to third parties who can use it under the same conditions. Once checked in, it is understood to be nominal and cannot be transferred to third parties. No additional discounts or conventions are applicable to the voucher rate. If you have a special convention of discounted rates please indicate it in your reservation. The convention, if any, will be applicable on the portion rate related to what is specified in the agreement.

(Cancellations) We remind you that in case of delays or cancellations, the amounts paid are not refundable. In compliance with what is specified in Art. 7 of Legislative Decree 185/99, there is no right of withdrawal for this presale, since it is, according to what is stated in paragraph b) of: provision of services related to leisure, for which the supplier undertakes to provide such services on a specific date or in a predetermined period. The Right of Withdrawal provided for in Articles 52 to 58 of the Consumer Code does not apply, right Art. 59 paragraph 1 letter n) of the same code; pursuant to Article 16 of Directive 2011/83/EU of the European Parliament, the right of withdrawal within 14 days does not apply to hotel reservations. Therefore, there is no refund of the price of the service paid/spent/booked/used, in case of cancellation by the buyer. The service cannot be exchanged for money, refunded, or used to purchase other products, educational materials and merchandise. In case of no show (no-show on the date of arrival or at the time of the start of activities) will occur the loss of the entire amount paid and the cancellation of the reservation.

(Convention with National Health System for access to the spa) In the case where the package includes spa treatments in agreement with the SSN, the presentation of the attending physician’s prescription is required in order to take advantage of the convention with the ASL. It is understood that in the case of packages that include spa treatments, with or without the prescription of one’s own treating physician, before accessing the treatments it will be necessary to carry out the introductory interview with the facility’s physician, which also includes the mandatory examination for admission to the treatments.

(Conditions for booking additional services provided by external provider) Pay special attention to the conditions for booking an activity provided by an external provider, as they may provide rates with more restrictive conditions than those applied by Millepini/Y-40®. Failure to comply with the conditions stated at the time of booking does not guarantee the provision of the service itself.

(Member card) A member card is a post-booking entry ticket; by purchasing a season ticket, the user can book entry at a later time after purchase; with web booking, the right of access to the hotel and facility is guaranteed; the day and time indicated in the web booking are binding for access to the hotel and facility; each time the season ticket is used to book a ticket, one entry is deducted from the total and the booking is non-refundable; it can be used by one person for multiple entries; it is nominal not transferable to a third party. Validity is limited to the date and shifts indicated in the document. Duration starts from the date of issue.

(Course) The course is a service that is understood to have prices per person; at the time of purchase it is not nominal and can be transferred to a third party who can use it under the same conditions. Once the course begins, it is understood to be nominal and cannot be transferred to a third party. It is valid for 365 days from issuance or by the date indicated on the document. In case of missed classes, a maximum of one between theory and practice will be made up. For prolonged absences, the Management is available to evaluate the best possibility of continuation. Enrollment and participation in the course does not a priori imply obtaining the certification (if any). Certification is awarded at the instructor’s discretion once the objectives set forth in the course have been mastered. In addition, the instructor reserves the right to evaluate the prerequisites required by the didactics at the initial stage of the course to allow for continuation. If open water dives (at the sea or lake) are planned, the costs of: travel, diving, access to dive sites, services provided by the diving center, possible room and board for themselves and the instructor are the responsibility of the student/student.

1.3 ASI MEMBERSHIP

(ASI Membership) Enrollment/participation in classes organized by Y-40®: trainers, courses, trainings, subscriptions, workshops, entails ASI (Italian Social Sports Associations – Sports Promotion Body recognized by CONI) membership – Y-40 S.S. DILETTANTISTICA a R.L. / VEN-PD0896. Those accessing first experience or diving with Y-40® guides/safety, can apply for annual membership, and enjoy the corresponding insurance coverage, upon presentation of the non-competitive or competitive sports medical certificate for any activity.

1.4 BOOKING PROCEDURE

(a) Online reservation;

(b) Personal account registration;

c) Subscription of regulations;

d) Check-in at reception of Y-40® and/or Hotel Terme Millepini, validation of entry and presentation of patent and medical certificate (where required by the type of activity).

1.5 DURATION OF ACTIVITIES

(Duration) The duration is specified by the management according to the organization of shifts and the activity to be performed. The term runs from the time indicated in the reservation. Management reserves the right to vary the timetable to allow the scheduled activities to take place.

(Timetable changes) To ensure the smooth running of the activities, and in any case for safety reasons, the Management reserves at its sole discretion, the right to make changes to the programs agreed upon and booked by the users with changes in the times and days of entry, interrupt the execution or even cancel the activities themselves, with the possibility for the user to obtain a voucher to refund the ticket. In no event shall the Hotel and Y-40® be liable for any additional damages (such as travel or accommodation expenses, etc.) that are consequential to the failure to provide the service and enjoy the planned activities.

(Delayed entry) Failure to show up or delayed arrival at the reception for access to the activities, indicated in the reservation, is grounds for termination of the contract, results in the termination of the right of entry to the activities and does not entitle to any refund. The management at its sole and unquestionable discretion, may allow, if the prerequisites and conditions are met, entry on another shift of the same day.

(Delay in leaving) Delay in leaving the water or the environments or services used, beyond the indicated time, will result in each offender paying the sum of €100.00 (one hundred) and/or the possible suspension of activities. The management, not being able to determine the reason for the delay, that is, whether it is a mere non-compliance with what is agreed and/or established in these regulations or an emergency situation, reserves the possibility at its discretion, to activate and call the first aid and fire brigade dive rescue with the costs of intervention charged to the person to be rescued and/or who caused the delay.

Disciplinary procedure in case of delay in leaving the water and occupying the next shift and/or end of shift:

  • Audible, visual, or verbal signal alerts participants of end of shift.
  • The staff or lifeguard invites participants to finish the activity and exit the water or service.
  • After five minutes have elapsed from the first invitation, for those who linger, the bathing attendant, shall proceed to a second invitation and notify the Management for the adoption of disciplinary and sanctioning measures.
  • Management within the 72-hour period may, at its discretion, require the offender to state the reasons for his or her tardiness.
  • Within the six-day period, Management shall take such disciplinary and sanctioning measures as it deems appropriate, in compliance with the regulations.
  • Measures and/or requests for clarification shall be communicated to offenders via e-mail.

 

1.6 CORRECT BEHAVIORS AND PROHIBITIONS

(Warn of presence) Please be advised that in order to access the facilities and before taking advantage of the services, you must always warn of your presence, the staff supervising and providing the services. In order to use the spa services and activities, you must follow the directions of the staff in charge.

(Communicate with staff) Those with medical conditions that pose a risk in using the facility are asked, for the protection of their own and others’ safety, to notify the staff on duty and/or the bathing attendant of their medical condition prior to accessing the activities. Particularly inexperienced clients should warn the lifeguards and remain in the pool area reserved for them; they are required to stay in the safety zone near the pool edge where it is possible to hold on to the supports.

(Behaviors not allowed) Management warns that the following behaviors are also not allowed inside and outside the facility, except in specially designated spaces:

  1. Smoking;
  2. Consuming food and/or beverages in locker rooms, restrooms, showers, and the pool room;
  3. Entering the locker room area and areas used by bathers with shoes on;
  4. Introducing dogs or other animals;
  5. Cackling, chasing each other, playing ball, harassing customers in any way or otherwise causing dangerous situations for themselves or others, inside the pool, on the poolside, in the pre-natal gymnastics areas, shower room and locker room;
  6. Having behavior contrary to decency. It is prohibited to shower without a bathing suit or to circulate or stand without a bathing suit in the locker room or shower room;
  7. Bringing objects of any kind into the pool that are not strictly related to the activities of the Hotel and Y-40®, including balloons, floating boards, inflatable mats and especially glass objects;
  8. Bringing personal bags/bags to the pool floor;
  9. Perform diving;
  10. Diving into the pool if one or more parts of the body are smeared with soaps or detergents, oils, creams and similar substances of any kind;
  11. Using soaps or detergents, oils, creams and similar substances of any kind while using the showers present at the poolside;
  12. Entry into the pool to those with wounds, skin injuries or bandages with plasters and bandages, subject to presentation of medical certificate.

 

(Interruption of activities) The Management reserves the right to temporarily suspend the entry of customers into the facility where this for any reason may be detrimental to the safety of users or for the necessity and urgency of carrying out work to restore the functionality and safety of the facility, for emergency situations from which even potential danger to the safety of users and service personnel may result.

(Expulsion) Management is empowered to expel from the facility those whose behavior disrupts public order or morals, or who, by means of noise, dangerous games or other demonstrations, jeopardize the safety of other users or otherwise harm the smooth operation of the service. The staff is authorized to remove persons who contravene the safety rules stipulated in the regulations.

(Exclusion from activities) The Management informs that failure to comply with the rules provided in the regulations may be grounds for exclusion from the activities themselves, whether they are in progress or future ones that Y-40® will put in place, in the course of its activities and without prejudice to the possibility for Y-40® to claim compensation for damages suffered.

(Notifications) Measures and/or requests for clarification shall be communicated to violators by email.
