GENERAL REGULATIONS - CHAPTER 4

General rules in the water

Within this section you will find the general rules that concern all water activities (which we will generically refer to as “diving”) and some specific rules for individual activities. In this case the provision will be preceded by an indication of the reference activity (e.g. freediving, scuba, etc.)
 
Unless otherwise indicated in the notices displayed and in the briefing, the immersion and surfacing of the participants in the activities must always take place at the same time for the group, even in the event of interruption of the same before the established time. Upon entering the water, the participant in the activities will have to wait for his partner and the group on the surface until the turn start signal communicated by the Y-40® lifeguard. Regardless of the certification exhibited and/or the qualification deduced, Y-40® reserves the right to ask the diver/freediver that the first dive is dedicated to verifying the skills and abilities acquired, in order to verify the compliance of the training with the certification same.

4.1 DIVING

(Freedive and Scuba dive certification): freedive/scuba dive certification is required, for related activities, except for first-time participants or 1st level course participants who dive with their own instructor. Instructor is required: freedive/scuba dive instructor’s patent, for related activities, diving insurance, medical certificate, and to be in active teaching status for their own teaching organization. The certification is not required for activities that do not specifically require it (newborn aquatics, aquagym, etc.). Athletes without a freediving certification but with special technical skills may only engage in the activity if expressly authorized by Y-40® Management.

(Buddy system): in independently organized activities is mandatory between certified freedivers / divers (minimum two people) either with their instructor or under his or her close supervision. Pair system in organized activities d Y-40® is formed by or directly with the Y-40® Instructor / Safety Y-40® / Guide Y-40® / Tutor and his assistant instructors. One has an obligation to comply with course directions and remain under their close supervision.

(Depth Activity Disclosure). The maximum depth allowed for freedivers and certified divers is the lower level depth of the pair. During instructional activities, the student may reach additional depths beyond the limit of the patent only if in the presence of the instructor and in no case beyond the limit of the next patent. If the maximum depth of the patent is not indicated, the depth indicated as the minimum should be taken as a reference. Freedivers are not allowed to perform static apnea or stop on the bottom beyond -15m depth. Divers are allowed only recreational diving within the safety curve. No Deco.

In case of:

  • -12m depth tickets, reduced use of the water space is allowed, limiting activities to the area with a bottom that does not exceed -12m.
  • Experience with Y-40® instructor, maximum depth is -12m from 15 years of age, -6m between 10 and 14 years of age, -2m between 8 and 9 years of age.
  • Safety Y-40®/ Guide Y-40®, diving is allowed within the participant’s maximum patent depth.
  • Trainer Y-40®, diving is allowed within and not beyond the limit of the next patent.
  • Y-40® courses: during the teaching activity, the student may reach additional depths beyond the limit of the patent only if in the presence of the instructor and in any case not beyond the limit of the next patent.
  • Y-40® Workshops with Tutor (e.g., champion, instructor, influencer), diving is allowed within the maximum depth established in the teaching program by the Tutor.
  • Y-40® training: the maximum depth allowed for freedivers and certified divers is the lowest level of the couple.

(Medical certification) For dives organized independently and/or organized by your own instructor, Y-40® does not require a medical certificate. For first Y-40® experiences, and dives with Safety Y-40® / Guide Y-40® a medical questionnaire provided by Y-40® is required. A valid medical certificate is required for dives with Y-40® Trainers, Workshops and Courses organized by Y-40®. Unless otherwise indicated, a non-competitive sports medical certificate with electrocardiogram (ECG) is required. A competitive sports medical certificate for any activity with stress ECG is required for the Y-40® workshop by Umberto Pelizzari.

(Freediving and scuba computers) A freediving/scuba computer is mandatory for every freediver/scuba diver, regardless of the depth reached. Each participant must have his/her own dive computer whose depth, time, and dive data must be able to be read by the pool staff. Management reserves the right to download the dive data to computer media for verification of compliance with the imposed rules. Refusal by the customer to submit his or her computer data for verification and download at the request of Y-40® staff is grounds for immediate exclusion from facility activities.

(Lanyard or Safety Lanyard) To access the well, the lanyard is mandatory regardless of the depth reached, hooking the carabiner to the white buoy where the descent cable runs, or above it. Each freediver may have his/her own or share it with the diving buddy or instructor. The assisting buddy may dive without a lanyard by reaching the maximum depth 1/3 the depth of the buddy who was performing the dive. The assisting instructor can dive without lanyard and without depth limit. The lanyard improves the freediver’s safety while diving by securing him or her to the descent cable, allowing their buddy or instructor timely assistance if needed.

(Equipment) For Apnea diving: free rental with ID to deposit for plastic or carbon fins and monofin (subject to limited availability). What to bring: patent, mask, snorkel, apnea computer, lanyard (already included in tickets with Safety Y-40® / Trainer Y-40® / workshop), fins and/or monofin, swimsuit, bathrobe, slippers and padlock. (Wetsuit and swimming cap not mandatory). Own equipment allowed, thoroughly washed and sanitized. For freediving course organized by Y-40®: you are guaranteed free rental with ID to deposit for plastic fins and monofin or charcoal mask, snorkel, freediving computer, lanyard (subject to limited availability) What to bring: patent if required in teaching standards, swimsuit, bathrobe, slippers and padlock. (Not mandatory wetsuit and cap). Own equipment allowed, thoroughly washed and sanitized. For scuba diving: free rental of fins, gav / jacket, tank, regulator. What to bring: patent, mask, dive computer, swimsuit, bathrobe, slippers and padlock. (Not mandatory wetsuit and cap). In case you want to use your own equipment, you must ask permission from info@y-40.com. Personal equipment must be thoroughly washed, sanitized and in working order. For diving course organized by Y-40®: free rental of fins, gav / jacket, tank, regulator, mask, dive computer. What to bring: certification if required in teaching standards, swimsuit, bathrobe, slippers and padlock. (Not mandatory wetsuit and cap). In case you want to use your own equipment, you must ask permission from info@y-40.com. Personal equipment must be thoroughly washed, sanitized and in working order. For sea/lake diving, of the Padi Open Water Diver course we provide: gav/jacket, cylinder, regulator; for all other courses you must have your own complete personal equipment.

(Rental fee): with deposit ID for: mask, computer (subject to limited availability). You may purchase from the Y-40® Shop: lanyard, costume, towel, flip-flops, padlock (subject to limited availability). Equipment taken for hire must be treated with diligence and returned in the state in which it was taken; in case of loss destruction and/or damage of used equipment, the diver is obligated to pay Y-40® a sum of money necessary to purchase the lost and/or destroyed equipment and/or to repair the damaged equipment. Equipment should always be stored in such a way that it does not pose a danger to oneself or other participants in the activities.

(Personal equipment) Personal equipment must be in perfect working order and suitable for the purpose used. It is the participant’s obligation to ensure the perfect functioning of their equipment. He must be able to use it without causing harm to himself or others. Personal equipment must be brought to the pool surface by hand, and must be rinsed in the appropriate tanks before the dive. For the use of particular equipment (particulars by way of example and not limited to: double tanks, phase tanks, rebreathers, scooters, gas mixtures, etc.) a permit must be requested from the Y-40® Management . The use of personal equipment, authorized by the Management, entails the assumption of full responsibility by the user and owner for any damage or event resulting from its use.

(Leads and diving knives) It is prohibited to use unrubberized leads or unprotected collars and to carry knives while diving.

(Prerequisites for all activities) In all of the above activities, the instructor/tutor reserves the right to assess the prerequisites required by the teaching at the initial stage of the lesson to allow for continuation.

(Obligations and Responsibilities for Participation in Activities) The participant who engages in in-water or out-of-water activities for himself/herself or in the company of minors for whom he/she has parental authority (or guardianship) is responsible for himself/herself and for the behavior of the minors he/she accompanies in the conduct of the activities. To this end, he/she is obligated to scrupulously respect and enforce the regulations of Y-40® and all directions, instructions and directives received from the instructor; strictly adhering to the route, depth and time of the dive and the directives indicated by the instructor, not straying on his/her own account, not taking initiatives not authorized or agreed upon during the briefing. Expressly recognizing the instructor’s right to: to establish the route to be followed, depth, dive time and safety stop; to be able, at any time during the dive, to make changes to the route, depth and dive time established during the briefing; to interrupt the dive in case of danger to one of the participants, third parties or the instructor himself, due to indiscipline or otherwise misbehavior or for any other reason also caused by third parties that may endanger his own safety or that of the other participants in the dive; renouncing as of now any claim for reimbursement of the entrance fee. Undertakes to promptly report to his/her buddy, instructor/guide any uncomfortable situation, before, during and after the dive (anxiety, excessive stress, cold, heat, fatigue). Scuba: for scuba diving, he/she undertakes to report air consumption especially the achievement of the residual 100 and 50 bar pressure indicated by the pressure gauge.

(Freediving) To access the shaft, the freediver must compulsorily secure their safety line to the descent cable. Respect the descent order and do not stay more than 30” seconds with the hand on the cable before the dive. For safety reasons, access to the three descent cables will be regulated by the Y-40® manager present at the poolside. Upon completion of the dive, the freediver must give the Ok signal to the buddy and release the cable quickly. During ventilation, each freediver shall stand in a position not to impede the diving activities and go to the safety cable access point only when authorized. The freediver who performed the dive must remain on the surface before performing the next dive a sufficient time to avoid hypoxia and in any case not less than three times the time taken in the previous dive. Hyperventilation technique is prohibited. The participant is required to abide by the good rules of freediving, the lessons learned during the freediving course, the limits of his or her license, and agrees to behave with diligent prudence and skill. The freediver agrees to abide by the alternating dive pair system. The freediving sessions will be conducted according to the alternating dive system with the obligation of supervision by the freediver who remains at the surface, who is to accompany the ascent to the surface of the freediver diving for the last stretch equal to one-third of the maximum depth reached in that dive. And to wait after the third breath for “the Ok”

(Scuba Diving) All dives must be scheduled to stay within the safety curve. Dives with decompression stops are not permitted unless specifically authorized by the Y-40® technical director. The ascent speed must be contained within the limit of 10 meters/minute. The diver who has arrived at an ascent depth of -5 meters, must make a safety stop between 3 and 5 minutes. in any case during the ascent the indications and the ascent speed indicated by your computer must be respected. It is mandatory to have a dive computer and knowledge of the international signals used in diving, an alternative air source, observance of the maximum depth provided by the certification, to carry out the dive within the no-decompression limits (safety curve) indicated by the computer or provided by the recreational dive planners of the didactics to which one belongs, the ascent speed indicated by the computer and/or tables, to ascend to the surface with a residual air in the cylinder of not less than 50 bar. When the activity is carried out independently with one’s buddy, the participant is obliged to respect the buddy system and to maintain throughout the dive control over the buddies, always positioning themselves at a close distance that allows immediate mutual rescue. Equipment must be donned and removed on the platform at -1.3m. It is forbidden to walk on the edge of the pool with the equipment on. Do not remove equipment during the dive unless authorized by your instructor.

(Caves) Freedive: for freedivers it is forbidden to enter the caves such maneuver is to be considered very dangerous. Scuba: for scuba divers the caves are accessible. For entry into the submerged tunnel (80 cm in diameter by 10 meters in length), access is restricted only to those with the appropriate certification (cavern, cave or equivalent) or those accompanied by an instructor.

(Break between two sessions/shifts) No two consecutive dive shifts are allowed. Observe a surface time of at least 60 minutes before making the second dive.

(In case of necessity) The participant declares that he/she has been informed that in case of necessity, he/she will have to request the intervention of lifeguards or authorized personnel.

4.2 ACTIVITIES ON THEIR OWN AND/OR ORGANIZED BY THEIR INSTRUCTOR

(Autonomous activities) The participant declares that he/she is informed that the activities carried out in Y-40® “autonomously and/or organized by one’s own instructor” means those organized and managed autonomously with one’s companion and/or by one’s own association/company/instructor (hereinafter referred to as: instructor) and carried out without any assistance from athletes-instructors from the staff of Millepini Immobiliare S.r.l. and Y-40® The Deep Joy S.S.D. a r.l. who merely provide assistance at the poolside.

(Freediving/scuba diving with own instructor/guide) The participant agrees to strictly abide by the Y-40® regulations and all directions, instructions and directives received from his/her own instructor/guide with whom he/she will conduct the activity, strictly adhering to the program (e.g., route, depth, dive time, ascent and safety stop, etc. ), indicated by the same, not straying from the group, expressly recognizing the right of the instructor/guide to make changes to the program; to stop the activity in case of danger to one of the participants, third parties or himself, due to indiscipline or otherwise misbehavior or for any other reason also caused by third parties that may endanger his own safety or that of the other participants.

4.3 DISCLOSURE OBLIGATION INDEPENDENT INSTRUCTORS/GUIDES, OR OF ASSOCIATIONS, COMPANIES

By signing this agreement, self-employed and association instructors/guides, societies (hereafter also referred to only as instructor), agree to abide by the general regulations and specific rules set forth below:

(Autonomous management) The instructor assumes full awareness:

  • That the activities by him are carried out independently and without any support from the staff of Y-40®.
  • That for the activities performed he assumes towards the participants, full and exclusive civil and criminal responsibility being the holder of a position of guarantee.
  • That for the aforementioned activities Y-40® is limited exclusively to ensuring the usability of the services of the facility whose operation he ensures.

 

(Title/Patent) It is mandatory to hold a suitable and valid title/patent to carry out the training/coaching activity issued by the above-mentioned institution/federation/teaching institution, using all or part of the Y-40® equipment; to hold a first aid and cardiopulmonary resuscitation (or equivalent) license in active status.

(Medical certificate and skills) You must be in a fit physical state to carry out teaching/training activities and have a valid medical certificate of fitness for sporting activity in compliance with current regulations; have the aptitude and ability to teach; be up-to-date on teaching methods and techniques imposed by the relevant institution/federation/teaching;

(Compulsory insurance) The instructor must have liability insurance valid for the duration of the course, covering all risks arising from the teaching of the activity with a limit of not less than what is provided by the institution/federation/teaching institution to which the instructor belongs.

(Teaching standards, pool rules and regulations) The instructor agrees to:

  • Comply with the provisions of the instructor agreement entered into with the respective institution/federation/teaching institution and the standards imposed by it;
  • Comply with the standards and rules stipulated in the Y-40® regulations;
  • Comply with the good rules of the technique of the sport activity performed and provided for in the UNI regulations.

 

(Previous and ongoing disputes) It is mandatory not to have ongoing and/or not to have had in the past, disputes and/or disciplinary proceedings for violation of the standards with the above-mentioned organisation/federation/education; that I have not received any civil and/or criminal convictions for damage caused to the health of the students and/or participants in the dive;

(Participant data) The instructor undertakes to keep a written list of all participants in the activities who access Y-40®, containing their names and personal details and to provide a copy to the management of the facility upon request;

(Responsibility for the students – position of guarantee) The instructor is aware that the organization and coordination activity of teaching the activity carried out involves the assumption of a position of guarantee towards the student and the participants in the activities. To this end, the instructor undertakes and therefore undertakes under his own responsibility to guarantee the safety and health of the people participating in the course/training and/or all activities in general, during all teaching phases including diving. recreational whether carried out with the aid of an air breathing apparatus or in apnea (even if they are carried out by other people belonging to one’s staff); the instructor undertakes and therefore undertakes to indicate and explain to the group of participants the correct behavior to be followed, foreseen by the Y-40® regulation and to demand compliance with the aforementioned regulation by the participants in the course/training and in the activities in question. type. In case of violation of the rules of conduct set out in the regulation and explained in the briefing, the instructor undertakes to report it to the management and undertakes, where appropriate, to suspend the activity in progress. The instructor is aware that failure or untimely communication of the violation of the regulations by the customer/student may result, at the discretion of the Y-40® management, in the exclusion of both the participant and the instructor from the activities.

4.4 ACTIVITIES ORGANIZED BY Y-40®

(Freedive/scuba diving with guide/safety, activity with trainer/training, with instructor/first experience/Y-40® course) Declares to be informed that the activity in the Y-40® pool is organized and managed by Y- 40® The Deep Joy S.S.D. to r.l. it will take place: a) with the help of a guide from the Y-40® staff; b) with the help of a trainer from the Y-40® staff who will have the qualification of instructor.

(First experiences), participation in the lesson does not a priori imply reaching the maximum depth of -12 m. The certificate of participation is assigned at the discretion of the instructor once the objectives of the lesson have been achieved. Furthermore, the instructor reserves the right to evaluate the prerequisites required by the teaching in the initial phase of the lesson to allow its continuation..

(Y-40® course for freediving/scuba for patent acquisition) The Management informs that the course in the Y-40® pool is organized and managed by Y-40® The Deep Joy S.S.D. a r.l which is carried out according to the teaching program and teaching standards; which is organized through practical and theoretical lessons; that the issuing of the license is not mandatory, but at the discretion of the instructor and follows the correct passing of the tests and the demonstration of the acquisition of the attitudes, skills and knowledge required to carry out the dives within the limits of the certification. This will be achieved only after the student has demonstrated that he possesses all the aptitudes, skills and knowledge necessary to carry out the dive within the limits set by the certification and to pass all the theoretical and practical tests.

(Workshop/Masterclass Y-40®) The Management informs that the workshop/masterclass is organized by the Tutor in collaboration with Y-40® The Deep Joy S.S.D. to r.l. The management of the course, which will take place according to the methods indicated in the program, is entrusted to the Tutor. The technical supervision of each sporting, educational and informational activity covered by the Workshop is the exclusive responsibility of the Tutor. Tutor is a person of renowned experience and competence; operates in complete autonomy and independence; and is not subject to the supervision of the Y-40® technical and course directors. Y-40® is responsible for logistical organisation, poolside safety and usability of the system. Y-40® will also manage any activity relating to the registration of participants. Y-40® declines all responsibility for everything relating to educational and technical activities, both theoretical and practical, whether they take place on dry land or in water; also declines any responsibility for what concerns the teaching methods and the information/notions provided during the Workshop by the Tutor.
