Images and brand

(Non-commercial images) Customers are permitted to take photographs and take audiovisual images inside the facility for recreational purposes only. It is forbidden, without specific authorization from Y-40®, to photograph or film audiovisual images or in any other form they are expressed (hereinafter all referred to as “images”), when the images themselves are finalized at the time of their creation or subsequently at the time of their dissemination for advertising, profit-making and/or commercial purposes and uses.

(Y-40® trademark) It is also forbidden, without specific authorization from Y-40®, to use in any form and for any reason the trademarks, distinctive signs and logos (hereinafter referred to as “trademarks”) of Y- 40®. Authorizations to use images and trademarks are not transferable to third parties; have a temporary nature limited to the promotion of a single event or course; anyone who intends to use the images and trademarks must request authorization for use for each individual event, demonstration and/or course. In any case, upon termination of the relationship between Y-40® and the authorized party, the revocation of the authorization to use the images and trademarks follows, with full and unquestionable right on the part of Y-40® to request the immediate removal and destruction of the material. The following symbols and wordings represent trademarks referable to Y-40®: Y-40® The Deep Joy; the deepest thermal pool in the world; Y-40® The Deep Joy; The world’s deepest pool with thermal water. Persons authorized to use images and trademarks must communicate to Y-40® the images and trademarks they intend to publish and the context in which they will be displayed. All images and brands in any form expressed and with any channel (printed, television, radio or web) published and disseminated must be specifically approved by Y-40® before their dissemination.

(Obligation of good faith) Whether they are permitted or authorized images or trademarks, their use must take place according to the general principles of correctness and good faith. Y-40® reserves the unquestionable right to request the removal and destruction of all images with illicit content, lacking common decorum or for any reason or reason deemed detrimental to the image and/or good commercial name of Y-40® , or images and brands where these are used in a manner different from what is provided for in this regulation, or are combined with other unwelcome brands or images; also reserves the right to bring any legal action that may be necessary for the violation of the aforementioned obligations and to protect its image. Those who receive specific authorization to make and publish images and/or use the Y-40® trademarks undertake not to publish and/or remove images already published upon written request, even without justification, from Y-40® , hereby waive the right to request justification and also waive the right to request any type or form of compensation and/or compensation for non-use and/or removal. Any costs for removing images are and remain the sole responsibility of the party who published or otherwise used them.

(Authorization to use images in favor of Y-40®) By signing this regulation, people who access the facility authorize Y-40® to portray them and/or at the same time to use images they have created themselves. The authorization to use the aforementioned images is to be understood as free and clear. Therefore, the undersigned declares to have understood all the obligations contained in this document and in particular those referred to in points: 5 (briefing), 8 (obligations for underwater activities), 9 (mandatory communications) and 10 (equipment); the information referred to in points: 1 (water activities), 2 (regulation, directives – resolution), 3 (exclusion from activities), 4 (facility), and 6 (diving information) and that you have provided the information referred to in point 7) in a truthful, exact and correct manner, without hiding elements that could affect the security of the evidence. He also declares that he has provided Y-40® with the additional information reported in the note in order to protect its safety. You are aware that, due to the occasional nature of the relationship, Y-40® is only in possession of the information referred to in this document and that therefore, if withheld or omitted, any other information useful for protecting your safety and security cannot be used . In this context, the undersigned assumes full responsibility for any consequences that may depend on the failure to understand or the false or incorrect compilation of this information sheet.
